Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the Roast My Outfit mobile application (the “Service”) operated by (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. The Service

Roast My Outfit is an entertainment application that uses artificial intelligence (AI) to generate humorous and satirical commentary (“Roasts”) based on images of outfits uploaded by you, the user (“User-Generated Content” or “UGC”). The Service is intended for personal, non-commercial entertainment purposes only.

2. User-Generated Content (UGC)

  • Ownership: You retain any and all of your rights to any photos or other content you submit, post, or display on or through the Service (“User-Generated Content”) and you are responsible for protecting those rights.  
  • License Grant: By uploading User-Generated Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and process your UGC solely for the purpose of operating the Service and generating an AI Roast for you. This license is limited to the functionality of the app and does not grant us the right to distribute or publish your UGC outside of the Service without your explicit permission.
  • Responsibility: We take no responsibility and assume no liability for Content you or any third-party posts on or through the Service. You are solely responsible for your UGC and the consequences of posting it. You warrant that: (i) the UGC is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your UGC on or through the Service does not violate the privacy rights, publicity rights, copyrights, or other intellectual property rights of any person.  

3. AI-Generated Content (Roasts)

  • Disclaimer of Accuracy: The Roasts generated by the Service are created by an artificial intelligence model. You acknowledge that this content is provided “as is” for entertainment purposes. We make no warranties regarding the accuracy, completeness, or reliability of any AI-generated Roasts.  
  • Nature of Content: The AI is designed to produce humorous, exaggerated, and satirical commentary which may be perceived as “acidic” or “dark humor.” Humor is subjective. We cannot guarantee that the content will not be offensive, inappropriate, or upsetting to some users.
  • No Liability: You expressly agree that your use of the AI-generated Roasts is at your sole risk. We disclaim any and all liability for any errors, omissions, or offensive material in the content produced by the AI technology. We are not responsible for any consequences, including emotional distress or social repercussions, arising from your use or sharing of AI-generated Roasts.  

4. Prohibited Conduct

You agree not to use the Service to upload, post, or otherwise transmit any User-Generated Content that:

  • Is unlawful, defamatory, discriminatory, harassing, abusive, threatening, harmful, obscene, or otherwise objectionable.  
  • Infringes any third party’s intellectual property or other proprietary rights, including but not limited to copyright and trademark.
  • Violates the privacy or publicity rights of any third party. You must have the explicit consent of any identifiable person in a photo before uploading it to the Service.
  • Is intended to bully, intimidate, or harm a targeted individual or group.  
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
  • Attempts to reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service.  

5. Account Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.  

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of and its licensors. The Service is protected by copyright, trademark, and other laws of both and foreign countries.

7. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.  

IN NO EVENT SHALL, NOR ITS DIRECTORS, EMPLOYEES, OR PARTNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.  

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Use within the application. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.  

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of, without regard to its conflict of law provisions.
